1. Introduction

These Terms & Conditions ("Terms") govern your access to and use of the NexEV mobile application, website, and EV charging network (collectively, the "Service") operated by NexCharge India Pvt. Ltd. ("NexEV", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

2. The Service

NexEV operates a network of electric vehicle (EV) charging stations and provides a mobile application and RFID cards that allow registered users to locate chargers, start and stop charging sessions, and pay for the electricity consumed via a prepaid in-app wallet.

3. Account Registration

To use the Service you must register an account using a valid mobile number and complete any verification (such as OTP) we require. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Wallet & Payments

  • Charging sessions are billed on a per-unit (per kWh) basis at the rate displayed for each charging station at the time of the session.
  • You must maintain a sufficient prepaid wallet balance to start and continue a charging session. Sessions may be automatically stopped if your balance is insufficient to continue.
  • All payments to top up your wallet are processed through our payment gateway partner (Cashfree) using UPI, debit/credit card, or net banking.
  • GST-compliant invoices are generated for each completed session and are available within the app.

5. Use of Charging Stations

You agree to use NexEV charging stations safely and only with vehicles and connectors compatible with the station. You are responsible for any damage caused by misuse of the charging equipment. NexEV is not liable for damage to your vehicle arising from manufacturer defects, incompatible equipment, or events outside our reasonable control.

6. Service Availability

While we strive to keep our charging network available at all times, charger uptime depends on factors such as power supply, network connectivity, and third-party maintenance. NexEV does not guarantee uninterrupted availability of any specific charging station.

7. Prohibited Conduct

You agree not to misuse the Service, including but not limited to: tampering with charging equipment, attempting to circumvent billing, sharing your account credentials for commercial resale of charging access, or using the Service for any unlawful purpose.

8. Limitation of Liability

To the maximum extent permitted by law, NexEV's liability for any claim arising from your use of the Service is limited to the amount paid by you for the charging session giving rise to the claim. NexEV is not liable for any indirect, incidental, or consequential damages.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after any changes constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.

10. Governing Law

These Terms are governed by the laws of India, and any disputes arising under them shall be subject to the exclusive jurisdiction of the courts at Tirupur, Tamil Nadu.
